Terms and Conditions of Sale
1. Purpose
These General Terms and Conditions of Sale (“GTC”) govern the sale of tickets granting access to events organized by Theme Expérience (“Theme Expérience” or “the Organizer”).
These GTC apply to any person purchasing or using a ticket for an event organized by Theme Expérience (“the Participant” or “the Customer”).
Ticket sales for Theme Expérience events are managed through the Shotgun platform, accessible at https://shotgun.live.
The purchase of a ticket implies full and unconditional acceptance of these GTC, as well as, where applicable, any specific terms and conditions applicable to the event in question and Theme Expérience’s Open Dance Floor Policy.
These Terms and Conditions are available prior to any purchase.
2. Organizer’s Identity
Theme Experience events are organized by:
Pol Souchier SASU
R.C.S. de Paris : 928 516 947
50 rue Bichat,
75010 Paris.
SIRET : 928 516 947 00019
TVA : FR10928516947
E-mail : team@theme-exp.com
This information will be supplemented and updated once the entity operating Theme Expérience is formally established.
3. Events and Announcements
The essential details of each event are listed on its event page and/or ticketing page, including:
- the date;
- the times;
- the venue;
- access requirements;
- the program, when available;
- the ticket categories and prices.
The information provided at the time of purchase determines the essential details of the service sold.
Theme Expérience may need to modify certain aspects of the event for reasons related, in particular, to production, safety, venue constraints, artist availability, or circumstances beyond its control.
In the event of a substantial change to the event or its cancellation, Theme Expérience will notify the affected ticket holders and, if applicable, specify the applicable terms for rescheduling or refunds.
4. Tickets
Tickets are sold through Shotgun App.
A ticket grants access to the corresponding event, subject to compliance with these Terms and Conditions, any special conditions listed on the event page, and the rules applicable at the venue.
Each ticket may be used only once, unless otherwise specified.
The procedures for digitizing, transferring, and, when available, reselling a ticket are those provided by Shotgun.
Theme Expérience recommends that participants use only the official transfer or resale features offered by Shotgun.
Theme Expérience does not guarantee the validity of tickets purchased through a third party or an unauthorized platform.
In the event of fraud, duplication, forgery, or fraudulent use of a ticket, access to the event may be denied.
5. Price
The ticket price is the price listed on the event page at the time of purchase.
Any service fees charged by Shotgun are displayed to the Customer before the purchase is confirmed.
The billing and payment terms implemented by Shotgun are also governed by the terms and conditions applicable to the use of the Shotgun platform.
Any service fees charged directly by Shotgun are separate from the ticket price paid to Theme Expérience. Shotgun currently states that these service fees may not be refundable under certain circumstances, particularly in the event of an event cancellation or postponement.
6. Order and Confirmation
The purchase of a ticket is completed through the ordering process provided by Shotgun.
Before final confirmation of the order, the Customer may review the event details, the applicable price, and the contractual terms that apply to them.
Confirmation of the order constitutes acceptance of these Terms and Conditions and forms the contract between the Customer and Theme Expérience regarding access to the event.
A confirmation notice and the ticket are then sent in accordance with the procedures provided by Shotgun.
7. Right of Withdrawal
In accordance with Article L. 221-28 of the Consumer Code, the right of withdrawal does not apply to the provision of leisure services that are to be provided on a specific date or during a specific period.
Consequently, the purchase of a ticket for a Theme Experience event scheduled for a specific date or period is not subject to the statutory 14-day right of withdrawal applicable to certain distance contracts.
This provision does not preclude any rights the Customer may have in the event of cancellation, postponement, or substantial modification of the event, depending on the circumstances and applicable legal provisions.
8. Cancellation, Rescheduling, and Refunds
8.1. Cancellation by Theme Expérience
In the event of an event cancellation, Theme Expérience will inform ticket holders of the applicable terms and conditions.
Unless otherwise provided by law or contract, the refund covers the ticket price paid for admission to the event.
Any service fees charged by Shotgun are subject to Shotgun’s applicable terms and conditions. Shotgun specifically states that these fees may not be refundable under certain circumstances.
8.2. Postponement of an Event
In the event of a postponement, Theme Expérience will notify ticket holders of the new date and the applicable terms and conditions.
When the postponement results in the possibility of a refund, the terms and deadlines will be communicated to the affected individuals.
8.3. Cancellation by the Customer
Subject to any features offered by Shotgun, including the resale or transfer of a ticket, a purchased ticket cannot be canceled solely at the Client’s initiative nor be subject to an automatic refund.
Shotgun currently allows, when the Organizer enables this feature, the resale of a ticket through its platform. The seller’s refund is then processed in accordance with the terms and conditions applicable to Shotgun’s resale feature.
9. Access to the event
Admission to the event is contingent upon presentation of a valid ticket.
The Organizer may require the presentation of identification, when necessary, particularly when the event has age restrictions or when tickets are non-transferable.
The specific admission requirements for an event are listed on its ticketing page.
The Organizer may deny admission or request the removal of a person, particularly in the following cases:
- an invalid, forged, previously used, or fraudulently obtained ticket;
- failure to comply with admission requirements;
- violent, threatening, discriminatory, or harassing behavior, or behavior likely to compromise the safety of others;
- failure to comply with the venue’s or staff’s safety instructions;
- behavior contrary to the Open Dance Floor Policy.
When exclusion results from the Participant’s misconduct, it generally does not entitle the Participant to a ticket refund.
These measures are taken without prejudice to the rights and remedies provided for by applicable law.
10. Dance Floor Policy
Participation in Theme Expérience events requires compliance with the Dance Floor Policy, available on the theme-exp.com website.
This policy outlines the principles of conduct, respect, safety, and coexistence that apply to the events.
It is an integral part of the terms and conditions governing participation in Theme Expérience events.
11. Photographic and Audiovisual Recording — Consent to Use of Image
11.1. Principle
Theme Experience events may be photographed, videotaped, and, where applicable, audio-recorded.

11.2. Consent Related to Ticket Purchase
By purchasing a ticket and participating in a Theme Experience event, the Participant grants Theme Experience, as well as any person or service provider authorized by Theme Experience, a free-of-charge, non-exclusive license to photograph and/or film the Participant during the event and to use, reproduce, display, adapt, and distribute the Participant’s image when the Participant appears in an identifiable manner in the resulting content.

- promotional and editorial content related to events.
11.3. Territory and Term
The authorization is granted worldwide and for a term of ten (10) years from the date of the relevant event.
It is granted free of charge and does not entail any transfer of ownership of the Participant’s image or personal attributes.
Theme Expérience may retain content already produced in its archives when necessary to preserve its editorial history, as evidence of its activities, or to defend its rights.
11.4. Limitations
The authorization granted does not permit any use of the Participant’s image that would be:
- taken out of context;
- defamatory or degrading;
- an affront to the Participant’s dignity;
- inconsistent with the purposes described in this section.
In particular, Theme Expérience may not use the Participant’s image to promote a third-party product or brand without additional authorization when such authorization is required.
11.5. Requests Regarding Images
Any person who appears in a recognizable manner in content published by Theme Expérience may contact the Organizer at team@theme-exp.com to obtain information about such content or to submit a request regarding its use.
Requests will be reviewed in light of the context of the recording, the authorization granted, the relevant rights, and applicable legal obligations.
11.6. Minors
When access to an event is open to minors, specific authorization requirements may apply in accordance with applicable regulations.
When authorization from a legal guardian is required, it must be obtained under the appropriate conditions.
12. Intellectual Property
All content on the theme-exp.com website and in Theme Expérience’s official materials, including text, photographs, videos, graphics, logos, visual identities, audiovisual works, and brand elements, is protected by applicable intellectual property laws.
Any unauthorized reproduction, display, modification, or use of this content is prohibited.
Participants are free to use photographs and videos they take themselves, provided they comply with applicable law, the rights of the artists, the rights of other people filmed, and the rules of the location.
13. Participant's Responsibility
The Participant is responsible for his or her conduct during the event and agrees to comply with:
- applicable regulations;
- safety instructions;
- the rules of the venue;
- instructions from staff and security personnel;
- these Terms and Conditions;
- the Dance Floor Policy.
The Participant is liable for any damage they may cause to Theme Expérience, the venue, the artists, service providers, or any other person as a result of their wrongful conduct.
14. Theme Experience's Liability
Theme Expérience is committed to taking all reasonable measures necessary to ensure the proper organization of its events.
Theme Expérience shall not be held liable in the event of non-performance resulting from an event constituting force majeure within the meaning of Article 1218 of the Civil Code or from an event beyond its control, subject to applicable mandatory provisions.
This limitation shall not have the effect of depriving the consumer of rights that he or she cannot legally waive.
15. Personal Information
Personal data processed in connection with ticket sales, event participation, and use of the website is handled in accordance with Theme Expérience’s Privacy Policy, available at theme-exp.com.
Since the ticketing system is operated by Shotgun, certain data is collected and processed on the Shotgun platform as part of the ticket ordering and management process.

18. Applicable Law and Jurisdiction
These Terms and Conditions are governed by French law.
In the event of a dispute with a consumer, the rules of jurisdiction set forth in the applicable legislation shall apply.
No provision of these Terms and Conditions is intended to deprive a consumer of the rights to which they are entitled under applicable mandatory provisions.
19. Changes to the Terms and Conditions
Theme Experience may amend these Terms and Conditions to reflect changes in its business activities, events, or applicable regulations.
The terms and conditions applicable to an order are those accepted by the Customer at the time of purchase, unless required by law to apply a change retroactively.
